1. Introduction
These are the terms and conditions that apply when you reserve a room at
Kingfisher Golf and Country Club Limited. You will be asked to confirm your
acceptance of these terms and conditions when you make a reservation.
We reserve the right to amend these terms and conditions at any time, please remember to read and check each time you make a
booking with us as they may have changed since your last booking. The terms and conditions applying to your
reservation will be those in place on the date that you make your reservation
unless we contact you.
Additional terms may apply to your use of our digital channels should
you make a reservation through them - these are published on the relevant
digital channel.
All bookings are subject to the conditions of booking and to
availability.
2. Reservations
To reserve your room please follow the instructions as applicable.
You must be at least 18 years old to make a reservation.
You will need to provide your credit or debit card details to secure
your reservation. Kingfisher Golf and Country Club Limited accepts Visa, Mastercard
and American Express to secure a reservation.
Please check that the details of your reservation are complete and
accurate before you confirm your reservation. We will not be liable if you
provide us with incorrect information.
We will confirm our acceptance of your reservation by sending you a
confirmation email to the email address provided during the reservation
process.
A contract between us will exist when:
a) we receive your booking and/or payment and
issue our written confirmation of your booking;
b) when booking by telephone or online, we
inform you that your booking is confirmed; or
c) when booking via a digital channel and you
receive confirmation that your booking is confirmed

mistake in your reservation or if you require any changes to a confirmed
reservation, please contact us to
discuss as soon as possible on 01908 562332 or email
reception@kingfishercountryclub.com. For more information on cancellation,
please see section 11 Cancellation, below.
We reserve the right to change your room allocation at any point during
your stay for any reason.
3. Group reservations
A reservation of five rooms or more is a group booking,
separate terms and conditions will apply. If you wish to make a group booking,
please call our team on 01908 562332.
4. Room prices
Kingfisher Golf and Country Club Limited adopt dynamic pricing and the
price of our rooms fluctuates. The price you pay is the price quoted to you at
the time you make your reservation.
Room prices are inclusive of VAT at the applicable rate at the time of
your reservation.
Prices are
non-commissionable unless stated.
For all bookings, a credit or debit
card must be provided to secure your reservation at the time of booking.
Flexible bookings: If you book a flexible rate, you may choose to pay in
full at the time of booking or to pay on arrival.
Advance purchase bookings: Payment in full is required for all advance purchase prices
at the time of booking. The whole reservation is fully non-refundable,
including any inclusive meals and other extras.
Should we be unable to process your card details to take this payment
for any reason your reservation will be deemed invalid, and a bedroom(s) may
not be reserved for you. Whilst every effort is made to advise you in this
event, it remains your responsibility to ensure that the hotel has been able to
do so. Please see section 11 cancellation for full rate restrictions.
5. Occupancy
The maximum room occupancy is three people, not exceeding two adults.
Cots are available for babies and children up to 3 years old. Rollaway beds
are available for children aged up to 12 years old priced at £20.00. These are
subject to availability and must be booked when you make your reservation.
Cots and rollaway beds are available with a maximum occupancy of two
adults and one minor.
We are unable to accommodate both a cot and a rollaway bed in our
bedrooms.
You must not exceed the maximum occupancy for the room allocated to you.
We reserve the right to conduct checks on occupancy. Occupancy is not
transferable.
Children
under 18 are not permitted to stay at Kingfisher Golf and Country Club Limited
unless a parent or guardian is also staying in the hotel. We reserve the right
to request valid photographic proof of identity and age, so please bring this
with you otherwise where requested you may not be permitted to stay.
6. Meals
Breakfast inclusive prices are
available, please check at the time of booking.
You may add dinner when you make your reservation, please speak to our
team on 01908 562332.
7.
Child Policy
Children
under 18 years old are not permitted to stay at Kingfisher Golf and Country Club Limited unless a parent or guardian is also staying in the hotel. Please
note that we are unable to allow children to stay in our Hummingbird Suite. We
reserve the right to request valid photographic proof of identity and age, so
please bring this with you otherwise where requested you may not be permitted
to stay.
To access
and use the KFitt gym, the sauna and steam room facilities guests must be 16
years and over. We reserve the right to request valid photographic proof of
identity and age
With a
full paying adult, children under 3 years
eat free.
We
respectfully ask that all children under 18 years old vacate Five Restaurant
and Spectrum Lounge by 9.30pm.
8. Events
Separate event Terms and Conditions apply, and these will
be shared at the time of booking with your Contract.
Deposits are based on the event price in the Contract and
are based on the day of booking. It represents an initial payment against the
final cost of your event.
Up to 6 months prior to the event - 25%
Between 6 and 4 months - 50%
Between 4 months and a month – 75%
Within a month of the event – 100%
Cancellations charges apply.
Full Terms and Conditions will be shared with your Booking
Contract.
9. Accessibility
Kingfisher Golf and Country Club Limited has two rooms which are
specially adapted for customers with disabilities.
10. Special requests
Although the Kingfisher Golf and Country Club Limited will try to
accommodate special requests, all rooms are subject to availability.
11. Cancellation
Your right to cancel
Flexible bookings:
Flexible bookings can be cancelled
up until 3pm the day prior to arrival. If you have paid
for the room in advance by debit/credit card, the refund will be processed to
the same debit/credit card used
Cancellations after 3pm the day
prior to arrival will be charged a cancellation fee equivalent to one night’s
total accommodation per room booked and for any meals and extras included within
the rate.
If you decide to
shorten your stay you must inform reception at least 24 hours in advance of the
day you wish to check out. Otherwise, you will be charged a cancellation fee equivalent to one night’s total accommodation per room booked
and for any meals and extras included within the rate.
Advance purchase bookings:
The whole reservation is fully
non-refundable, including any inclusive meals.
A cancellation reference will
be given and should be retained as proof of cancellation.
Please note there are no
refunds for ‘no shows.
If you’ve made a group
booking, cancellation terms are as per your group contract and terms and
conditions. Please call the team on 01908 562332.
Our right to cancel
We may cancel your reservation at any time with immediate effect by
giving you written notice (which includes email) if: you do not pay us when you are required to do so or
you break the contract between us in any way.
If we cancel your reservation where you are at fault, we reserve our
legal rights in respect of your breach of contract. Where your stay has/has
not yet commenced, the total payment made or to be made by you for such room
shall be deemed a cancellation charge and is not for any service.
12.
Force Majeure
The Hotel accept no responsibility
and shall not be deemed to be in breach of
this Booking Contract, or otherwise be liable,
if the booking has to be cancelled or amended as a result of a force
majeure event - an event beyond their control of
unusual or unforeseeable events and circumstances. This includes, but is not
limited to; war, civil commotion, riot, industrial dispute, any law or action
taken by the government or public authority, terrorist activity and
consequences, natural or nuclear disaster, fire, floods, adverse weather
conditions, epidemics and pandemics.
In the case of Force Majeure, we will contact you to let you know as
soon as possible and if you have already paid for your room, we will refund
your payment to you; or if you have not yet paid for your room, you will not
have to make any payment to us.
13.
Parking
The
hotel cannot guarantee space availability in the hotel car park at any time and
parking is available on a first come first serve basis. The hotel car park is
strictly for the use of the hotel guests and visitors only.
The
hotel may withdraw or suspend its parking facilities at any time without
notice.
Vehicles
must be parked in the defined limited of a single parking space. All vehicles
parking in a space designed as being for use by either a ‘Disabled Permit
Holder’ or ‘Authorised Permit Holder’ must clearly display an appropriate valid
current permit.
All
use of the hotel car park shall be entirely and absolutely at the user’s risk
and the hotel accepts no liability for any loss or damage to any vehicle,
however caused, including the removal by the hotel of any unauthorised or
incorrectly parked vehicle from the car park.
14. Payments
All payments must be made in Pound Sterling. We are unable to accept
foreign currency exchange at the Kingfisher Golf and Country Club Limited.
All bookings must be guaranteed with a valid debit/ credit card at the
time of booking.
Where the reservation has not been prepaid, payment should be made on
arrival.
Please note we are unable to use a third-party credit card to settle any
outstanding balance outside of the confirmation terms even if it was used to
secure the booking. We will require a card to be physically present for it to
be used as a means of payment to charge incidentals to your bedroom account.
All guests will be asked for a debit/credit card (chip and pin) preauthorization
upon check-in at the hotel. Our preauthorization policy amount is the sum of
the total charges reserved for your stay (if not pre-paid), plus £50 per adult,
per night to cover incidental charges to the bedroom account.
Where preauthorization is taken, full payment must be completed upon
departure (which must be chip and pinned). Where it is not possible to preauthorize
the total room charges reserved, Kingfisher Golf and Country Club Limited
reserves the right to cancel your reservation at 100% cancellation fee.

Payment may be made by credit/debit card (Visa, MasterCard, American
Express). The expiry date of your debit/credit card must be later than the end
of your stay. We do not accept cheques or cash at reception. In the case of
AMEX cards, particularly (but not restricted to) those issued oversees, which
must be ‘swiped’ rather than chip and pinned the hotel reserves the right to
check validity of the card with the AMEX voice authorization service and/ or
our Merchant. Cards which are not authorized will not be accepted.
Guests are required to clear all outstanding balances with Reception
upon check-out.
15. Arrival and departure
Rooms are available from 3pm on the arrival date. Please let Kingfisher
Hotel, Golf & Country Club know if you are likely to arrive after 10pm.
Guests will be asked to provide proof of identity and nationality upon
check-in. Overseas guests, excluding Republic of Ireland and Commonwealth
citizens, will be asked to provide their identity card / passport details.
Acceptable forms of identification are a passport, driving licence, ID card or
police warrant card.
Rooms must be vacated by 11:00am on the day of departure. Failure to
leave your room by this time may result in a late check-out charge.
16.
Smart TVs: Security and Data Protection
All our bedrooms and suite feature a smart TV and you are invited to
enjoy the many extra viewing opportunities provided. However, please note that
if you input any personal account details, pin numbers, passwords, or other
personal information into this TV, unless all such information is removed by
you before you leave your bedroom, it could possibly enable anybody entering
your room after you, to gain access to those applications which you have
accessed and possibly to gain access into your personal data.
Please therefore be sure to delete any personal information you have
entered (whatever its nature) before leaving your bedroom. For example, if you
enter your Netflix account ‘sign in’ details to access Netflix services, you
must be sure to ‘sign out’ of your account – not to just simply exit the app.
This is crucial for your data security. Please be advised that the hotel will
not under any circumstances be responsible or liable to you in any way should
you enter any information, whether you have signed out / deleted it or not.
Any decision by you to enter any information or details is made entirely
at your own risk.
17.
Guest own food preparation/ cooking in bedrooms and public areas
Any
form of food preparation and/ or cooking in the bedrooms or public areas is
strictly prohibited. This includes (but is not restricted to) the use of
portable smoothie blenders, sandwich toasters, or crockpots. In addition,
kettles provided by the hotel may only be used for the purpose of boiling water
to make hot beverages and not as a means of cooking/ boiling other foodstuffs
(whether in water or otherwise).
18. Kingfisher Golf and Country Club Limited
expectations of you (and your group)
You must not:
·
smoke anywhere
inside any Kingfisher premises. This includes the smoking of e-cigarettes.
Permitted smoking areas will be identified on site. Smoking on Kingfisher
premises outside of the designated smoking area will result in a £250 fine.
·
bring any pets
onto the hotel premises, with the exception of assistance dogs.
·
bring any
potentially dangerous or hazardous materials or equipment into the hotel or on
the premises
·
use any electrical
appliances that may set off the fire alarm system.
·
tamper with any
fire alarms or emergency equipment.
·
utilize Kingfisher
Hotel, Golf & Country Club rooms to use or store items (personal or
otherwise) which could in the sole opinion of Kingfisher Golf and Country Club Limited cause damage to the room, or be a risk to the health and safety of
staff or property. This includes any items with a naked frame.
·
prevent Kingfisher
Hotel, Golf & Country Club management, housekeeping and/or maintenance
staff from access to your room(s) as and when required, with housekeeping
permitted full access at least once every two days.
·
remove, damage, or
destroy any Kingfisher Golf and Country Club Limited property.
·
use any of the
technology provided by the Kingfisher Golf and Country Club Limited to
download or access any unlawful or obscene material; or cause unreasonable
disturbance to our other guests or any Kingfisher Golf and Country Club Limited staff.
If you or your group cause damage or loss of any kind to the hotel,
other guests, or their property, you (as the person making the booking) will be
responsible for that damage or loss and you shall be liable to pay to
Kingfisher Golf and Country Club Limited on demand the amount required to make
good or remedy such damage or loss.
You and the members of your group must not resell or transfer your
reservation (or any part of it) nor advertise, market, or otherwise offer any
Kingfisher Golf and Country Club Limited room for sale either on its own or as
part of a combined offer. Kingfisher Golf and Country Club Limited will not
honour any reservations made in this way and does not accept any liability for
doing so. If you are a Tour Operator and wish to book rooms at a Kingfisher
Hotel you should contact our team directly on 01908 562332.
If you or your group cause damage to the hotel, other guests, or
their property, or otherwise breach any of these terms and conditions,
Kingfisher Golf and Country Club Limited reserves the right to:

cancel your
reservation with immediate effect and (if appropriate) eject you from the premises.
·
cancel key cards.
·
restrict access to
the hotel.
·
remove your items
from the room and hotel, disposing of such items (at no cost and no liability)
to a local charity to the extent such items are not collected from us within 7
days of removal.
·
retain all sums
paid by you and/or charge you the full amount of your reservation; and/or
·
refuse future
reservations from you and/or refuse you entry or accommodation at any of our
hotels.
Kingfisher Golf and Country Club Limited will not be liable for any
refund or compensation in such circumstances.
Kingfisher Golf and Country Club Limited reserves the right to decline
or cancel reservations made and stays in progress by those who have previously
breached these terms and conditions (as may be updated from time to time),
whether the reservation is in that name or not.

making a reservation, you consent (on your behalf and on behalf of each member
of your group) to such processing and you warrant that all information provided
by you is accurate.
The contract
This contract formed when we confirm your reservation is between you and
us. No other person shall have any right to enforce any of its terms, whether
under the Contracts (Rights of Third Parties Act) 1999 or otherwise.
Your rights
If you are a non-business customer, you have certain rights under
consumer protection legislation. Nothing in these terms and conditions is intended
to affect those rights.
Our liability
We accept liability for death and personal injury arising from our
negligence or that of our employees and agents. We do not seek to exclude our
liability for fraudulent misrepresentation by us or our employees or agents.
We do not accept liability for failure to meet any of our obligations
where such failure is due to events beyond our reasonable control.
If we breach these terms and conditions for reasons within our control,
we shall only be liable for losses that are direct losses and a reasonably
foreseeable consequence of such breach.
Save as prohibited by applicable law, we shall not be liable whether in
contract, tort (including negligence) or for breach of statutory duty, or in
any other way, for any indirect or consequential losses including:

loss of income, sales,
or revenue.

loss of business.

business interruption.
·
loss of profits or
contracts.
·
loss of
anticipated savings.
·
loss of data.

loss of reputation
and/or goodwill; or

Where we are liable to you (save as prohibited by applicable law) our
maximum liability to you whether in contract, tort (including negligence) or
for breach of statutory duty shall in no event exceed the price of your
reservation unless the Hotel Proprietor's Act 1956 applies, in which case our
liability will be limited to the maximum prescribed under that Act.
Applicable law
These terms and conditions, their subject matter and formation (and any
non-contractual disputes or claims) are governed by and construed in accordance
with English law.
If you are a consumer, you and we both agree that the courts of England
and Wales will have non-exclusive jurisdiction over any claim arising from, or
related to, your reservation and/or stay at Kingfisher Golf and Country Club Limited. We retain the right to bring proceedings against you for breach
of these terms and conditions in your country of residence or any other
relevant country. If you are a resident of Northern Ireland, you may also bring
proceedings in Northern Ireland, and if you are resident of Scotland, you may
also bring proceedings in Scotland.
If you are making a business reservation, you and we agree that the
courts of England and Wales will have exclusive jurisdiction over any claim
arising from or related to your reservation and/or stay at Kingfisher Country
Club.
Severability
If any part of these terms and conditions is deemed invalid, illegal or
for any reason unenforceable then that part will be deemed deleted and will not
affect the validity and enforceability of the remaining parts. Any failure by
us to enforce our rights or remedies under these terms and conditions or
otherwise shall not be construed as a waiver by us of those or any other rights
or remedies.
All rights not expressly granted in these terms and conditions are
reserved.

• When booking with us, we don’t ask for accessibility, dietary, health or other sensitive personal data. Personal information we collect:
We collect personal information when you book with us or request or use our services. This includes hotel and restaurant visits, using our websites or apps, or corresponding with us. We may also receive personal data about you from another source. This includes:
• Personal Identifiers - title, name, marital status, postal and email addresses, postcode, IP addresses and contact telephone numbers. We may also collect the names of those who are part of a group booking where necessary, and the age of children to meet your needs (e.g. to provide a cot) and enable us to confirm any restrictions that may apply to a room booking;
• Business-to-Business Information - for corporate customers and corporate business leads and contacts: job title, business address and business email address;
• Transaction Information - payment, reservation and booking details, including meals, beverages & car parking;
• Membership information - membership details for rewards and Kingfisher Country Club Ltd Business Account programmes;
• Shareholder information – where you present a Kingfisher Country Club Ltd shareholders’ card;
• Facebook Page Insights Data - In relation to our Facebook Pages, we may receive Insights Data from Facebook, i.e. aggregated data that can help us to understand how visitors are engaging with our Page, which may be based on personal data collected during your visit to our Page or its contents. In relation to the processing of this personal data only, we are joint controllers with Facebook Ireland Limited. Facebook Ireland Ltd has agreed to take primary responsibility under the GDPR for the processing of Insights Data and to comply with all applicable obligations under the GDPR with respect to the processing of Insights Data, so all requests and queries should be addressed to Facebook Ireland Limited. o making, amending or administering your room booking and meal orders;

o to administer your ‘My Kingfisher’ account or Business Account;
o to administer your Kingfisher Business Account;
o communicating with you;
o providing customer services, including managing complaints; and
o alerting you by text, email or phone in the event of an unplanned incident, as a result of which we have to make alternative arrangements under our contract (or where we believe it is in your vital interests).
If the information we request is not provided, we may not be able to enter into or comply with a contract or our legal obligations;

Restructure and sale
We may restructure our internal group of companies so that different group companies run our hotels and related services. So, for example, in the future Kingfisher Country Club Ltd (or another group company) may take over responsibility for the running and operation of hotels from Kingfisher Golf and Country Club Limited . If this happens we will let you know and your data may be shared with such company and processed as set out in this notice.
In the event that the business is sold or integrated with another business, your details may be disclosed to our advisers and any prospective purchaser’s adviser and will be passed to the new owners of the business.
International transfers

How long will you retain my personal data?
We keep your data to enable us to fulfil our contract with you or to provide services, where required by law, to respond to a question or complaint, to obey rules about keeping records, to uphold or protect contractual or legal rights or where it is in your or another party’s vital interests or our legitimate interests. Where we process personal data on the basis of your consent, we will retain it only for as long as required for the specified purpose. GENERIC BOOKINGS’ TERMS
All bookings are subject to availability.
All bookings are subject to a discretionary service charge of 10%.
Bookings of 6 or more guests need to be placed by phone directly with our reservation team or by email.
For bookings where a deposit is taken, the deposit will be redeemed against your final bill. In the event of a cancellation with less than 48hrs notice your deposit will not be refunded.
Reservations can be made online through our website and using our third-party booking system “TOCK”.
Bookings can also be made directly in situ, by phone on 01908 562332 or by emailing us to fb@kingfishercountryclub.com
Please specify the day and time of your booking, number of people, contacts of main organiser and dietary requirements when placing your enquiry.
Bookings made online through our reservation system are automatically confirmed as soon as you receive email confirmation.
Enquires for bookings made by any other means are only confirmed after our team processes it, checks availability and contact you directly with confirmation. We attempt to answer to your enquires in 2 business days. If you don’t hear from us by then, please kindly contact us again.
Booking’s confirmation can be done by phone or email, to any of your contacts provided.
Card details might be required to confirm your reservation.
We do not hold your card details in file. This information is processed and secured by a third-party card processing company. For specific information on how we treat and store your data check our privacy policy.
In the event that the booking is not honoured in whole or in part, or it is cancelled with less than 7 days’ notice, a cancellation fee of £50 per person might be applied.
If we attempt to contact you to confirm your booking and are unable to reconfirm your booking 7 days prior to your required date, we reserve the right to release the table.

COVID-19 BOOKINGS REQUIREMENTS
All guests in your party must check in individually by using the provided NHS app QR Code.
If this is not possible, names, phone numbers and emails will be collected by our team.
All guests are required to use face coverings while indoors in our venues unless dining.
We operate with TABLE SERVICE only. Direct serving at the bar is not allowed.
Payments to be made by card, preferably.
Subject to government restrictions, at the moment the total number of guests in your party is 6. This restriction is due to be lifted by the 21st June. Please confirm with us directly before booking your party for more than 6 guests.
FIVE AT KINGFISHER - Specific Terms & Conditions
Bookings require 24h advanced notice.
Same day bookings and walk-in are possible, but dependent on availability.
Should card details be required to secure your booking please note that if the booking is not honoured or is cancelled with less than 48hrs notice a cancellation fee of £50 per person will be charged to the card. Please note that special terms & conditions may apply for key seasonal dates.
On your booking day, you will be assigned a table that best suits your party size and 2 hours slot. After 2 hours the table will need to be released.

Terrace availability cannot be guaranteed, and it is dependent on weather conditions on the day.
